Acceptance of Terms

By registering an account or using our Service, You agree to comply with this Agreement. We may update this Agreement at any time; please review it periodically. If You do not agree, do not use the Service.

1. Registration

By registering, you affirm that you are of legal age to form a binding contract, and that all information you provide is accurate and complete. We reserve the right to terminate or suspend your account for violations of this Agreement.

2. Minors

The Service is not for users under 18. If you are under 18, you are not allowed to use the Service.

3. Ownership and Intellectual Property

All content and software related to the Service are proprietary to us or third parties. Unauthorized use of any proprietary content is strictly prohibited.

4. Your Registration and User Content

Any data or content you upload remains your intellectual property. We reserve the right to use this data as necessary for the Service.

5. License to Use

You are authorized to use the Service for personal, non-commercial purposes. Premium Services are only accessible if you pay the applicable fees.

6. Payment

6.1 If you purchase Premium Services, you agree to pay the fees and taxes. Non-payment may result in Service termination.

6.2 Subscriptions will auto-renew unless canceled. No refunds are provided for canceled subscriptions.

6.3 Refunds are only available within 35 days of purchase and are not applicable to Lifetime purchases.

7. Interactive Features: Forums, Chat Spaces, and Blogs

A variety of features within the Service, such as sharing macro-nutritional information with friends, forums, chat areas, and blogs, provide opportunities for information exchange ("Interactive Features“). Hit My Macros does not edit or control User Content you or other Users post or distribute through the Interactive Features and shall not be responsible for User Content. Hit My Macros does not vet Users or individuals using the Service or Interactive Features and assumes no liability for any loss or damage incurred through the use of the Interactive Features. All Users should exercise caution when interacting with unknown individuals, just as they would in the real world.

Prohibited Actions for Users of Interactive Features:

• Violate any local, state, national, or international laws while using the Interactive Features.
• Impersonate any person or entity, or forge headers to disguise the origin of User Content.
• Harvest or collect information about others, including email addresses, without consent.
• Post any material repetitively or engage in "spam.“
• Inhibit others from using the Interactive Features or expose Hit My Macros or its agents to any liability or detriment.

7.4.9 Keeping Our Community Safe

We’ve made our policy clearer: using Hit My Macros to create or share illegal, harmful, or offensive content is strictly prohibited. This helps ensure our community remains a positive and supportive space.

8. Service Restrictions

Users shall not upload or post any material that:

• Is defamatory, threatening, abusive, or encourages criminal offense.
• Contains commercial solicitation or advertising material.
• Violates copyrights, privacy rights, or other third-party rights.
• Involves a foreseeable risk of injury or harm to others.
• Contains malware, viruses, or any code designed to interrupt or damage software.

9. Hit My Macros Rights

Hit My Macros reserves the right to:

• Record User Content.
• Investigate allegations that User Content violates this Agreement.
• Remove User Content that is abusive, illegal, or disruptive.
• Monitor and disclose any User Content and general use of the Service.
• Edit or delete any User Content, whether or not it violates any terms.

10. Links to Third-Party Websites

The Hit My Macros app may contain links to third-party websites. These links are provided for convenience only and do not imply endorsement or affiliation. Users should investigate these third-party sites as deemed necessary.

11. Ideas and Suggestions

Hit My Macros welcomes your ideas and suggestions for improving the Service ("Service Comments“). All Service Comments will be the sole property of Hit My Macros and may be used for any purpose, commercial or otherwise, without obligation or compensation to the User.

12. Warranty and Disclaimers

Warranty Disclaimers, Limitations of Liability and Indemnity

You acknowledge that Your diet and exercise activities involve risks, which may involve risk of bodily injury or death, and that You assume those risks. You should consult a licensed/certified healthcare professional prior to beginning or modifying any diet or exercise program that You undertake, and You acknowledge that Hit My Macros has advised You of the necessity for obtaining such consultations. The Service should not be used by pregnant women. The Service is a source of information, but it does not provide medical advice. Hit My Macros makes no representation that Hit My Macros is a provider of medical services as defined by federal and state laws and regulations pertaining to medical providers and other health care related matters, or that Hit My Macros has any obligations with respect to (a) the appropriateness of Your engaging in a weight loss program; (b) the results (or lack of results) obtained by Your use of the Services; and (c) any health-related matters arising in connection with Your use of Hit My Macros.

Use of Coaches

Hit My Macros does not screen or test Coaches nor verify the qualifications or experience of any Coach, and Hit My Macros is not responsible for any advice, recommendation, act or omission of any Coach. If You use a Coach in connection with the Service, You do so at Your own risk. You accept the responsibility of verifying whether the Coach is appropriately qualified or experienced and of determining for Yourself whether You should follow any advice or suggestions from the Coach.

Coaches

You shall only act as a Coach if You have appropriate skills, experience and qualifications to do so. If You provide coaching services to any Individual User, You agree that Hit My Macros is not responsible or liable for any act or omission of the Individual User or for the fitness of an Individual User to receive coaching services. Hit My Macros does not screen Individual Users and is not responsible for determining whether an Individual User is prepared for or medically fit for a diet or exercise regime.

Warranties

WITHOUT LIMITATION OF THE FOREGOING, Hit My Macros AND Hit My Macros AFFILIATES MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE SERVICE OR USER CONTENT. THE SERVICE AND USER CONTENT ARE PROVIDED IN “AS-IS” CONDITION, AND Hit My Macros AND Hit My Macros AFFILIATES EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED TO THE EXTENT PERMITTED BY LAW, INCLUDING: ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NONINFRINGEMENT, AND ANY AND ALL WARRANTIES ARISING FROM COURSE OF DEALING AND USAGE OF TRADE; THAT THE SERVICE AND USER CONTENT WILL MEET YOUR REQUIREMENTS, WILL ALWAYS BE AVAILABLE, ACCESSIBLE, UNINTERRUPTED, TIMELY, SECURE OR OPERATE WITHOUT ERROR, AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE OPERATION, USE OR OTHER EXPLOITATION OF THE SERVICE AND USER CONTENT, AND AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED FROM THE SERVICE OR THE USER CONTENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM Hit My Macros OR ANY Hit My Macros AFFILIATE OR THROUGH THE SERVICE OR USER CONTENT WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.

YOU USE THE SERVICE AND USER CONTENT AT YOUR OWN RISK, AND NEITHER LOSE IT! NOR Hit My Macros AFFILIATES WILL BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM OR RELATING TO ANY OF THEIR OPERATION, USE OR OTHER EXPLOITATION.

UNDER NO CIRCUMSTANCES WILL YOU BE ENTITLED TO RECOVER FROM Hit My Macros OR Hit My Macros AFFILIATES ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, PUNITIVE OR SPECIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS OR LOSS OF USE), WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE ARISING FROM OR RELATING TO THE SERVICE OR USER CONTENT, EVEN IF Hit My Macros OR Hit My Macros AFFILIATES HAVE BEEN INFORMED OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES.

THE MAXIMUM AGGREGATE LIABILITY OF Hit My Macros AND Hit My Macros AFFILIATES FOR ANY AND ALL DAMAGES ARISING IN CONNECTION WITH YOUR USE OF THE SERVICE OR THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT OF FEES PAID BY YOU TO Hit My Macros IN THE THREE (3) MONTHS BEFORE THE LIABILITY IS ALLEGED TO HAVE ARISEN, OR, IF NO AMOUNTS WERE PAID DURING SUCH PERIOD, THE AMOUNT OF $1. THIS LIMITATION WILL APPLY WHETHER THE DAMAGES ARE BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF WARRANTIES OR OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

You shall defend, indemnify and hold harmless Hit My Macros and Hit My Macros Affiliates against any and all claims, actions, proceedings, suits, liabilities, losses, damages, costs, expenses and attorneys’ fees arising in connection with Your use of the Service or Your breach of any provision of this Agreement. Hit My Macros reserves the right the assume the sole control of the defense and settlement of any claim, action, suit or proceeding for which You are obliged to provide indemnification hereunder. You will cooperate with Hit My Macros with respect to such defense and settlement.

13. Link to the Privacy Statement

Hit My Macros operates the Service under the Privacy Policy published at http://HitMyMacros.app/privacy-policy. We urge you to read this policy now and regularly check this page to review any changes we might make.

14. Digital Millennium Copyright Act

The Digital Millennium Copyright Act of 1998 provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law.

16. Applicable Law and Jurisdiction; Compliance

All disputes arising out of or relating to this Agreement or the Service shall be resolved exclusively by binding arbitration.

17. Use of Artificial Intelligence (AI) (New Section 14)

Hit My Macros now includes tools powered by generative AI (like food image recognition) to help improve your experience. These tools are meant for food-related use only and shouldn’t be used to make health- or other high-stakes decisions. Also, please don’t upload things like facial images, ID documents, or medical records unless the app specifically asks for them. You’re responsible for checking that the output makes sense before relying on it.

18. Account Security (New Section 15)

You’re responsible for keeping your login credentials private. Keep your credentials secure and do not let others use your account. Any activity under your account is your responsibility.

19. Cloud Services and Third-Party Services

Without limitation of the disclaimers and limitations of liability, you acknowledge and agree that we provide the Service using cloud computing services of one or more third-party cloud providers.

20. Miscellaneous Provisions

No delay or omission by Hit My Macros in exercising any of its rights will impair any such right or be construed to be a waiver thereof.
